Terms of Use

The Terms apply to any existing services/features and new services/features that ÉclatBlue may introduce in future.
ÉclatBlue may modify the Terms or add additional terms from time to time without notice.
Continued usage will be considered acceptance of all updated Terms; It is your responsibility to check the relevant terms here.
The Services are provided solely for your personal use only and not for your or your organization's commercial purposes unless an explicit contract and fees, whether free or not, is agreed upon between ÉclatBlue and you.
ÉclatBlue may at its sole discretion modify or discontinue all or any part of the Services or terminate your access to all or any part of the Services at any time without notice.
ÉclatBlue shall not be liable to you for any active or terminated Services.

No Warranties

You use the services at your sole risk.
The services are provided on an "as is" and "as available" basis without warranty of any kind.

Limitation of Liability

You expressly agree that ÉclatBlue, its founders, officers, directors, employees, agents and partners shall not be liable to you for any lost data, goodwill, profits or other tangible or intangible losses or special, indirect, incidental, punitive, exemplary and consequential damages, resulting from (i) your use or inability to use of the services; (ii) any errors, omissions, or inaccuracies in any data obtained through the services; (iii) any other matter relating to the services.

Additionally, for users accessing free or anonymous services (includes, but not limited to, testing), ÉclatBlue holds zero financial liability for any inaccuracies or service outcomes.
For paid users with explicit contracts, the total collective liability of ÉclatBlue and its affiliates for any outcomes shall not exceed the amount paid by the user to ÉclatBlue in the prior twelve (12) months or fifty ($50) USD, whichever is greater.

Indemnification

You agree to indemnify and hold ÉclatBlue and its founders, officers, directors, employees and partners harmless from any claim or demand, and expenses, including reasonable attorneys' fees that arise from your use or misuse of the Services, violation of the Terms by you, or your violation of any rights of any third party.

Service Disclosures

1. One-Click Auth: By using this service, you acknowledge you will receive a transactional email containing your login details. Your email address will be processed by our third-party email service provider to log delivery details as proof of transmission. Furthermore, you consent to ÉclatBlue securely retaining your email address as a unique identity identifier alongside active renewal tokens strictly to maintain, validate, and secure your active login sessions.

2. no_phish: By using this service, you explicitly acknowledge that threat analysis results are probabilistic and not 100% accurate, and that the service is provided strictly for informational purposes only. It is intended to function as a single layer of a broader, multi-layered security strategy. You further acknowledge and agree that ÉclatBlue logs and retains the searched URLs and their corresponding analysis results strictly to train our detection algorithms, track threat history, and improve service performance.

3. Domain Security & Rate Limiting: Across all ÉclatBlue services and public interfaces, logged in user email addresses and incoming IP addresses are processed and logged strictly for rate-limiting, cybersecurity monitoring, server abuse prevention, and infrastructure protection purposes.
